1) Services

MayKim Rentals provides party and event rental products and services, which may include delivery, setup, takedown, and pickup depending on the order. Availability, pricing, and service areas may change at any time.

2) Quotes, Reservations, and Order Confirmation

• Quotes: Quotes are estimates and may change based on availability, delivery details, labor, taxes, and other factors.
• Reservation: A reservation is confirmed only when we accept your order and (if applicable) required payment/deposit is received.
• Accuracy: You are responsible for providing correct event date/time, address, contact info, and any access instructions.

3) Payments, Deposits, and Fees

• Payment terms: Payment requirements may vary by order size and type of equipment.
• Delivery fees: Delivery fees may depend on distance, tolls, parking, stairs/elevators, and access conditions.
• Additional labor: Additional labor fees may apply for difficult access, long carries, stairs, or time delays not disclosed in advance.

4) Cancellations, Changes, and Refunds

• Order changes: Changes are subject to availability and may affect pricing.
• Cancellations: Cancellation terms may vary by timing and product type. Deposits and reservation fees may be non‑refundable once your date and equipment are reserved. Same‑day cancellations are not refundable.
• Rescheduling: If you need to move your event date, we will try to accommodate based on availability. Pricing may change if rates or service requirements change.
• Weather: Certain rentals (e.g., tents) may be affected by weather conditions and safety requirements. For safety, we may delay, modify, or cancel setup/installation when conditions are unsafe.

5) Delivery, Setup, and Site Conditions

• Access: You must ensure safe and legal access to the delivery/setup location, including parking/loading access.
• Timing: Delivery/pickup windows are estimates. Delays may occur due to traffic, weather, or operational issues.
• Surface and placement: You are responsible for confirming the placement area is suitable (level, safe, and clear of hazards).
• Permits: If permits are required (parks/buildings), you are responsible for obtaining them unless we agree otherwise in writing.

6) Customer Responsibilities, Damage, and Loss

• Care of equipment: You are responsible for equipment from the time it is delivered until it is picked up.
• Damage/loss/theft: You may be charged for missing, stolen, or damaged items beyond normal wear.
• Safety: Do not move equipment after setup without approval. Keep items away from open flames, extreme heat, and unsafe conditions.

7) Prohibited Use

You agree not to misuse the Site. This includes attempting to interfere with the Site’s security, servers, or networks, or using the Site for unlawful purposes.

8) Intellectual Property

The Site content, branding, logos, text, images, and design are owned by or licensed to MayKim Rentals and may not be used without permission.

9) Third-Party Services and Links

The Site may include links or embedded content from third parties (e.g., social media). We are not responsible for third-party services, content, or privacy practices.

11) Disclaimer of Warranties

The Site and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied.

12) Limitation of Liability

To the fullest extent permitted by law, MayKim Rentals will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

13) Indemnification

You agree to defend, indemnify, and hold harmless MayKim Rentals from claims arising out of your use of the Site or rented equipment, your event, or your violation of these Terms.

14) Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.

15) Changes to These Terms

We may update these Terms from time to time. The “Effective Date” indicates the latest revision. Continued use of the Site means you accept the updated Terms.
